Terms of Service

These terms are an agreement between you and Mainstream Freedom ("we", "us") covering your use of mainstreamfreedom.com (the "Site") and any order you place. By using the Site or placing an order, you agree to these terms and to ourPrivacy Policy. If you do not agree, please do not use the Site. You must be at least 18, or use the Site under the supervision of a parent or guardian.

Products and orders

Our products are made to order. Colors can vary slightly from what you see on screen, and placement of printed or embroidered designs can vary within normal production tolerances. Your order is an offer to buy; we accept it when we confirm it by email. We may refuse or cancel any order, for example on suspicion of fraud or a pricing error, and if we cancel a paid order you receive a full refund.

Pricing and payment

Prices are in US dollars and can change at any time. The price charged is the price shown at checkout, plus any shipping and applicable sales tax calculated there. Payment is handled by a PCI-compliant payment processor; your card details never reach our servers. Promotional codes have no cash value and may be withdrawn or limited at our discretion. If a listed price is an obvious error, we may cancel the order and refund you.

Shipping, returns and refunds

Our Shipping and Returns policy forms part of these terms. Because items are made to order, the remedies described there are the exclusive remedies for order problems.

Accounts

You are responsible for keeping your account credentials confidential and for activity under your account. Give us accurate information and keep it current. We may suspend or close accounts used in violation of these terms.

Reviews and other content you submit

When you submit a review or other content, you give us a perpetual, royalty-free license to use, display and reproduce it in connection with the store, along with the name you submit it under. Submit only content you wrote, keep it honest and lawful, and do not include personal information about others. We may decline to publish or may remove any content at our discretion.

Acceptable use

Do not misuse the Site: no unlawful activity, no interfering with its operation or security, no scraping or bulk copying of content, no impersonating others, and no submitting false orders or reviews.

Intellectual property

All designs, artwork, product images, logos, copy and other Site content belong to Mainstream Freedom or its licensors. Buying a product gives you the physical item, not any rights to reproduce the design. Do not copy, reprint or resell our designs without written permission.

Communications

We send transactional email about your orders and account. If you give us your phone number and agree to receive texts, we may text you about your order; message and data rates may apply, reply STOP to opt out or HELP for help. Consent to texts is never a condition of purchase.

Disclaimer of warranties

The Site and its content are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the Site will be uninterrupted or error-free.

Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from an order is limited to the amount you paid for that order, and our total liability for any other claim related to the Site is limited to one hundred dollars. We are not liable for indirect, incidental, special or consequential damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to defend and hold us harmless from claims arising out of your violation of these terms or misuse of the Site.

Disputes, arbitration and class action waiver

Most concerns can be solved fastest by contacting us directly. Otherwise, you and Mainstream Freedom agree that any dispute arising from these terms or an order will be resolved by binding individual arbitration administered by JAMS under its rules, rather than in court, except that either party may bring a qualifying claim in small claims court. Disputes must be brought individually: both parties waive any right to participate in a class action or class-wide arbitration. You may opt out of this arbitration agreement by emailing us within 30 days of your first order.

Governing law

These terms are governed by the laws of the State of New Jersey, without regard to conflict of law rules. Any proceeding not subject to arbitration must be brought in the state or federal courts located in New Jersey.

General

If any part of these terms is found unenforceable, the rest remains in effect. These terms, the Privacy Policy and the Shipping and Returns policy are the entire agreement between us about the Site. We may assign our rights under these terms in connection with a sale or reorganization of the business; you may not assign yours. We may update these terms from time to time; the latest version always lives at this URL and applies to orders placed after it is posted.
